Key Changes to Korean IP Laws including shorter period for opposition and increase in punitive damages (effective from July 22, 2025)

 Trademark opposition period shortened to 30 days ​​
The trademark publication period and opposition window in South Korea will be significantly reduced from the current 2 months to 30 days. This new rule will apply to all pending applications to be published on or after July 22, 2025.

The trademark opposition window has been significantly reduced, making it advisable to act quickly once a counterpart application is published. 

It is also important to note that no extensions are allowed for the trademark opposition period, as before in South Korea.



 Quintuple Punitive Damages for Willful Trademark and Design Infringement ​​​
Starting July 22, 2025, the maximum punitive damages for trademark and design patent infringement in South Korea will increase from three times the damages to up to five times. 

This follows a previous change in August 2024, which raised punitive damages for utility patent and trade secret infringement, as well as idea theft, to the same fivefold limit.

The increased punitive damages will significantly impact enforcement, encouraging more rights owners to participate in litigation, while potential infringers will need to exercise greater caution.
